{"id":8204,"date":"2025-09-12T16:00:30","date_gmt":"2025-09-12T15:00:30","guid":{"rendered":"https:\/\/avocatrabat.com\/?p=8204"},"modified":"2025-09-12T16:00:30","modified_gmt":"2025-09-12T15:00:30","slug":"procedure-deviction-dun-locataire-dun-local-commercial-pour-defaut-de-paiement-de-loyers-au-maroc","status":"publish","type":"post","link":"https:\/\/avocatrabat.com\/en\/procedure-deviction-dun-locataire-dun-local-commercial-pour-defaut-de-paiement-de-loyers-au-maroc\/","title":{"rendered":"Proc\u00e9dure d\u2019\u00e9viction d\u2019un locataire d\u2019un local commercial pour d\u00e9faut de paiement de loyers au Maroc"},"content":{"rendered":"<h2 data-start=\"622\" data-end=\"641\"><strong data-start=\"625\" data-end=\"641\">Introduction<\/strong><\/h2>\n<p data-start=\"642\" data-end=\"919\">La location d\u2019un <strong data-start=\"659\" data-end=\"687\">local \u00e0 usage commercial<\/strong> est encadr\u00e9e par la <strong data-start=\"708\" data-end=\"752\">loi n\u00b0 49-16 relative au bail commercial<\/strong>.<br data-start=\"753\" data-end=\"756\" \/>Lorsqu\u2019un locataire cesse de payer son loyer pendant plus de trois mois, le bailleur est en droit d\u2019engager une <strong data-start=\"868\" data-end=\"892\">proc\u00e9dure d\u2019\u00e9viction<\/strong> pour r\u00e9cup\u00e9rer son bien.<\/p>\n<p data-start=\"921\" data-end=\"1055\">Cette proc\u00e9dure est cependant <strong data-start=\"951\" data-end=\"975\">strictement encadr\u00e9e<\/strong> afin de prot\u00e9ger les droits du bailleur tout en garantissant ceux du locataire.<\/p>\n<hr data-start=\"1057\" data-end=\"1060\" \/>\n<h2 data-start=\"1062\" data-end=\"1087\"><strong data-start=\"1065\" data-end=\"1087\">1. Fondement l\u00e9gal<\/strong><\/h2>\n<p data-start=\"1088\" data-end=\"1120\">La loi marocaine pr\u00e9voit que :<\/p>\n<ul data-start=\"1121\" data-end=\"1425\">\n<li data-start=\"1121\" data-end=\"1268\">\n<p data-start=\"1123\" data-end=\"1268\">Visit <strong data-start=\"1126\" data-end=\"1151\">non-paiement du loyer<\/strong> pendant une dur\u00e9e de <strong data-start=\"1173\" data-end=\"1199\">trois mois cons\u00e9cutifs<\/strong> constitue un <strong data-start=\"1213\" data-end=\"1231\">motif l\u00e9gitime<\/strong> de r\u00e9siliation du bail commercial.<\/p>\n<\/li>\n<li data-start=\"1269\" data-end=\"1425\">\n<p data-start=\"1271\" data-end=\"1425\">L\u2019\u00e9viction ne peut toutefois intervenir qu\u2019apr\u00e8s le respect d\u2019une proc\u00e9dure sp\u00e9cifique, destin\u00e9e \u00e0 assurer un \u00e9quilibre entre les droits des deux parties.<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"1427\" data-end=\"1430\" \/>\n<h2 data-start=\"1432\" data-end=\"1468\"><strong data-start=\"1435\" data-end=\"1468\">2. Les \u00e9tapes de la proc\u00e9dure<\/strong><\/h2>\n<h3 data-start=\"1470\" data-end=\"1509\"><strong data-start=\"1474\" data-end=\"1509\">A. Mise en demeure du locataire<\/strong><\/h3>\n<p data-start=\"1510\" data-end=\"1620\">Avant toute action judiciaire, le bailleur doit <strong data-start=\"1558\" data-end=\"1592\">mettre en demeure le locataire<\/strong> de r\u00e9gler les loyers dus.<\/p>\n<ul data-start=\"1621\" data-end=\"1824\">\n<li data-start=\"1621\" data-end=\"1691\">\n<p data-start=\"1623\" data-end=\"1691\">La mise en demeure doit \u00eatre adress\u00e9e par <strong data-start=\"1665\" data-end=\"1688\">huissier de justice<\/strong>.<\/p>\n<\/li>\n<li data-start=\"1692\" data-end=\"1824\">\n<p data-start=\"1694\" data-end=\"1824\">Elle pr\u00e9cise le <strong data-start=\"1710\" data-end=\"1740\">montant exact des arri\u00e9r\u00e9s<\/strong> et accorde un <strong data-start=\"1755\" data-end=\"1791\">d\u00e9lai suppl\u00e9mentaire de 15 jours<\/strong> pour r\u00e9gulariser la situation.<\/p>\n<\/li>\n<\/ul>\n<h3 data-start=\"1826\" data-end=\"1866\"><strong data-start=\"1830\" data-end=\"1866\">B. Saisine du tribunal comp\u00e9tent<\/strong><\/h3>\n<p data-start=\"1867\" data-end=\"1917\">Si le locataire ne r\u00e9gularise pas la situation :<\/p>\n<ul data-start=\"1918\" data-end=\"2120\">\n<li data-start=\"1918\" data-end=\"2002\">\n<p data-start=\"1920\" data-end=\"2002\">Le bailleur saisit le <strong data-start=\"1942\" data-end=\"1964\">tribunal comp\u00e9tent<\/strong> du lieu de situation de l\u2019immeuble.<\/p>\n<\/li>\n<li data-start=\"2003\" data-end=\"2120\">\n<p data-start=\"2005\" data-end=\"2120\">Le tribunal examine la demande et peut prononcer la <strong data-start=\"2057\" data-end=\"2080\">r\u00e9siliation du bail<\/strong> ainsi que l\u2019<strong data-start=\"2093\" data-end=\"2119\">expulsion du locataire<\/strong>.<\/p>\n<\/li>\n<\/ul>\n<h3 data-start=\"2122\" data-end=\"2163\"><strong data-start=\"2126\" data-end=\"2163\">C. D\u00e9cision judiciaire d\u2019\u00e9viction<\/strong><\/h3>\n<p data-start=\"2164\" data-end=\"2206\">Le juge, apr\u00e8s examen du dossier, peut :<\/p>\n<ul data-start=\"2207\" data-end=\"2400\">\n<li data-start=\"2207\" data-end=\"2258\">\n<p data-start=\"2209\" data-end=\"2258\">Constater le <strong data-start=\"2222\" data-end=\"2244\">d\u00e9faut de paiement<\/strong> persistant.<\/p>\n<\/li>\n<li data-start=\"2259\" data-end=\"2299\">\n<p data-start=\"2261\" data-end=\"2299\">Ordonner la <strong data-start=\"2273\" data-end=\"2296\">r\u00e9siliation du bail<\/strong>.<\/p>\n<\/li>\n<li data-start=\"2300\" data-end=\"2400\">\n<p data-start=\"2302\" data-end=\"2400\">Autoriser l\u2019<strong data-start=\"2314\" data-end=\"2340\">expulsion du locataire<\/strong> et, le cas \u00e9ch\u00e9ant, de toute personne occupant les lieux.<\/p>\n<\/li>\n<\/ul>\n<h3 data-start=\"2402\" data-end=\"2437\"><strong data-start=\"2406\" data-end=\"2437\">D. Ex\u00e9cution de la d\u00e9cision<\/strong><\/h3>\n<p data-start=\"2438\" data-end=\"2480\">Une fois la d\u00e9cision d\u00e9finitive rendue :<\/p>\n<ul data-start=\"2481\" data-end=\"2680\">\n<li data-start=\"2481\" data-end=\"2540\">\n<p data-start=\"2483\" data-end=\"2540\">L\u2019huissier de justice proc\u00e8de \u00e0 l\u2019<strong data-start=\"2517\" data-end=\"2537\">ex\u00e9cution forc\u00e9e<\/strong>.<\/p>\n<\/li>\n<li data-start=\"2541\" data-end=\"2593\">\n<p data-start=\"2543\" data-end=\"2593\">Le locataire est contraint de lib\u00e9rer les lieux.<\/p>\n<\/li>\n<li data-start=\"2594\" data-end=\"2680\">\n<p data-start=\"2596\" data-end=\"2680\">En cas de r\u00e9sistance, l\u2019huissier peut requ\u00e9rir le <strong data-start=\"2646\" data-end=\"2679\">concours de la force publique<\/strong>.<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"2682\" data-end=\"2685\" \/>\n<h2 data-start=\"2687\" data-end=\"2727\"><strong data-start=\"2690\" data-end=\"2727\">3. Cons\u00e9quences pour le locataire<\/strong><\/h2>\n<p data-start=\"2728\" data-end=\"2773\">En cas d\u2019\u00e9viction pour d\u00e9faut de paiement :<\/p>\n<ul data-start=\"2774\" data-end=\"3054\">\n<li data-start=\"2774\" data-end=\"2878\">\n<p data-start=\"2776\" data-end=\"2878\">Le locataire perd le <strong data-start=\"2797\" data-end=\"2843\">droit au renouvellement du bail commercial<\/strong>, normalement prot\u00e9g\u00e9 par la loi.<\/p>\n<\/li>\n<li data-start=\"2879\" data-end=\"2999\">\n<p data-start=\"2881\" data-end=\"2999\">Il ne b\u00e9n\u00e9ficie pas de l\u2019<strong data-start=\"2906\" data-end=\"2930\">indemnit\u00e9 d\u2019\u00e9viction<\/strong>, d\u00e8s lors que la r\u00e9siliation est fond\u00e9e sur un <strong data-start=\"2978\" data-end=\"2996\">motif l\u00e9gitime<\/strong>.<\/p>\n<\/li>\n<li data-start=\"3000\" data-end=\"3054\">\n<p data-start=\"3002\" data-end=\"3054\">Il reste tenu de payer les <strong data-start=\"3029\" data-end=\"3051\">arri\u00e9r\u00e9s de loyers<\/strong>.<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"3056\" data-end=\"3059\" \/>\n<h2 data-start=\"3061\" data-end=\"3102\"><strong data-start=\"3064\" data-end=\"3102\">4. Droits du bailleur et garanties<\/strong><\/h2>\n<ul data-start=\"3103\" data-end=\"3404\">\n<li data-start=\"3103\" data-end=\"3168\">\n<p data-start=\"3105\" data-end=\"3168\">Le bailleur peut r\u00e9cup\u00e9rer son bien et le relouer \u00e0 un tiers.<\/p>\n<\/li>\n<li data-start=\"3169\" data-end=\"3295\">\n<p data-start=\"3171\" data-end=\"3295\">Il peut r\u00e9clamer le paiement des loyers dus ainsi que des <strong data-start=\"3229\" data-end=\"3253\">dommages et int\u00e9r\u00eats<\/strong> si un pr\u00e9judice particulier est \u00e9tabli.<\/p>\n<\/li>\n<li data-start=\"3296\" data-end=\"3404\">\n<p data-start=\"3298\" data-end=\"3404\">La proc\u00e9dure judiciaire permet d\u2019obtenir une d\u00e9cision ex\u00e9cutoire, s\u00e9curisant ainsi son droit de propri\u00e9t\u00e9.<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"3406\" data-end=\"3409\" \/>\n<h2 data-start=\"3411\" data-end=\"3439\"><strong data-start=\"3414\" data-end=\"3439\">5.
